TERMS AND CONDITIONS FOR USE OF TROPICAL PARADISE’S MALDIVESTRAVELLER.MV WEBSITE AND ITS APPLICATION MALDIVES RESORT DIRECTORY.

Please review the following User Agreement carefully before using this web site and its Application. You should also read the Maldives Traveller Privacy Policy.

1. Introduction

Welcome to the MaldivesTraveller.mv (“Website”) and Maldives Resort Directory ("Application"). This Website or Application is owned and operated by Tropical Paradise Private Limited, (“Tropical Paradise”) STO Trade Centre 01-02, Orchid Magu, Male’ Maldives. These terms and conditions govern your use of this Website and its Application produced by Tropical Paradise, including participation in the Website’s or Application's chat, review and forum facilities (“Community Areas”). Please read these terms and conditions carefully. Since the Website or Application is designed to provide a forum for the robust and free-flowing exchange of information, reviews, opinions and comments, and an enjoyable and informative experience for all, Tropical Paradise requires its users to abide by certain rules. Your use of the Website or Application will constitute your agreement to comply with these terms and conditions. If you do not agree with these terms and conditions, please do not use the Website or the Application. These terms and conditions may be modified by Tropical Paradise from time to time. Notice of revisions will be announced on this page. Continued use of the Website by you will constitute your acceptance of any changes or revisions to these terms and conditions, so it’s wise to check this page regularly. Your failure to follow the Website’s or Application's rules, whether set out in these terms and conditions or posted at other locations on the Website or Application, may result in termination of your access to the Website or Application, without notice.

2. Use of the Website or Application by You

All material on the Website or Application belongs to Tropical Paradise or its licensors. You may retrieve and display content from the Website or Application on a computer screen or your device, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on any server or other storage device connected to a network) for your own personal, non-commercial use. You may not in any way make commercial or other unauthorised use, by publication, re-transmission, distribution, performance, caching or otherwise, of material obtained through the Website or Application. You acknowledge that Maldives Traveller is business name for Tropical Paradise Private Limited and that you may not use it without written permission from Tropical Paradise. You may not authorise others to use the Website or Application, and you are responsible for all of your own use of the Website or the Application. You agree not to use any obscene, indecent or offensive language, or to place on the Website or Application any material that is false, defamatory, abusive, harassing or hateful. Further, you may not place on the Website or Application any material that is encrypted, constitutes junk mail or unauthorised advertising, invades anyone’s privacy, encourages conduct that would constitute a criminal offence or give rise to civil liability, or that otherwise violates any local, state, national or international law or regulation. You agree to use the Website or the Application only for lawful purposes and you acknowledge that your failure to do so may subject you to civil and criminal liability. Other than connecting to MaldivesTraveller.mv host servers by HTTP/S requests or Downloading the Application from the Application hosts, using a Web browser or viewing the Application from your device, you may not attempt to gain access to MaldivesTraveller.mv’s servers by any means, including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Website or Application otherwise. You are responsible for ensuring that any material you provide to the Website or through the Application or post in a Community Area, including but not limited to text, photographs and sound, does not violate the copyright, trademark, trade secret or any other personal or proprietary rights of any third party. You agree not to disrupt, modify or interfere with the Website or Application or its associated software, hardware and servers in any way, and you agree not to impede or interfere with others’ use of the Website or Application. You further agree not to alter or tamper with any information or materials on, or associated with, the Website or the Application. You acknowledge that Tropical Paradise has not reviewed and does not endorse the content of all sites linked to from our Website or Application and is not responsible for the content or actions of any other sites linked to from our Website or Application. Linking to any other service or site from our Website or Application is at your sole risk.

3. Links

Any third party web site that links to our Website or Application must not: – create a frame or any other browser or border environment around the content of our Website or Application; – imply that Tropical Paradise is endorsing it or its products or services; – use any Tropical Paradise trademark displayed on any Tropical Paradise web site without permission from Tropical Paradise; – infringe any intellectual property or other right of any person; – be a web site that contains content that could be construed as distasteful, offensive or controversial. Tropical Paradise expressly reserves the right to request that any link in breach of these terms be removed and to take whatever other action it deems appropriate.

4. Use of Material Posted by You

Postings to the Community Areas and comments, photos and reviews on other sections, including listings are not private. You grant Tropical Paradise and its designees a perpetual royalty free non-exclusive license to use, reproduce, republish, modify, translate, transmit, distribute and sub-licence any information or material you supply or communicate to the Website or Application via such postings, in any medium now in existence or hereafter developed, for any purpose, including commercial uses. All other information and material you supply or communicate to the Website or Application is governed by the Privacy Policy, which is accessible at any time from the bottom of the Website or information icon on top of the main home of the Application.

5. Copyright Complaints

Tropical Paradise respects the intellectual property of others, and we ask our users to do the same. Tropical Paradise may, in appropriate circumstances and at its discretion, terminate the access of users, subscribers and account holders who infringe the copyright rights of others. If you believe that your work has been copied and is accessible on any Tropical Paradise web site or Application in a way that constitutes copyright infringement, or that the Website or Application contains links or other references to another online location that contains material or activity that infringes your copyright, please contact Tropical Paradise.

6. Comments and reviews by Users Are Not Endorsed by Tropical Paradise

Tropical Paradise does not necessarily endorse, support, sanction, encourage, verify or agree with the comments, reviews, opinions or statements posted by users in Community Areas or elsewhere in the Website or in the Application. Any information or material placed online by users, including advice and opinions, is the view and responsibility of those users and does not necessarily represent the view of Tropical Paradise.

7. Offers and Prizes

From time to time Tropical Paradise will run competitions or offers, free prize draws and promotions on our website or Application. These are subject to additional terms that will be made available at the time.

8. Direct Communications

Through the Website or the Application you will be able to send direct queries to the resorts or properties listed on the Website or the Application, on that case you are exposing your information to such a resort or property. Tropical Paradise will not involve on such a communications. The resort or such a property will communicate or reply to your queries directly.

9. Indemnification

You agree that Tropical Paradise is not responsible, and shall have no liability to you, with respect to any information or materials posted by others, including defamatory, offensive or illicit material.

10. Editing and Deletions

Tropical Paradise reserves the right, but undertakes no duty, to review, edit, move or delete any material posted by users in the Community Areas or elsewhere on the Website or the Application, in its sole discretion and without notice.

11. Accommodation and Tour Bookings

Through the Site, Tropical Paradise provides an online platform through its Website or Application which you can browse or view different types of accommodations and Tours, including but not necessarily limited to resorts, hotels, guesthouses, experiences and activities, etc. By making a booking through the Website or Application, you make an offer to book a reservation at the price listed for such reservation and agrees to share your information (name and nationality) to such resort, hotel, guesthouse and liveaboard to process your reservation or booking. You will receive proof of the reservation status via an e-mail confirmation (with a voucher for prepaid Tours and Accommodations), which means the reservation has been confirmed. The “thank you page” means your reservation request has been received and is under for final processing, no further action is required by you. We reserve the right to reject bookings as set out below.

We reserve the right not to accept you or bookings (or in exceptional cases to cancel confirmed ones) at our discretion and for whatever (legal) reason without the need to justify such refusal. Typical reasons for rejecting you or booking include, breach of the Terms of Use, suspicious bookings, force majeure events, trade or economic sanctions, embargoes, legal restrictions, (suspicions of) fraud or theft, suspected criminal activity, submission by you of misleading or erroneous information, Payment Instrument problems, inappropriate behaviour, threats, insults, violence, refusal to supply information, practical obstacles, communication problems, obvious errors, history, blacklisting by governments or international organisations (EU, USA, UN, Maldives), etc. In case a booking is rejected or cancelled by Tropical Paradise and a payment has already been made, you will receive a refund of the total booking value, except in the any appropriate case that we determine in our sole and absolute discretion where we reserve the right not to refund the total booking value or any part thereof. We reserve the right to bar (“blacklist”) users from the Site, on a permanent or temporary basis, at our discretion. Any such blacklisted user must not attempt to use the Site under any other name or through any other user.

12. Cancellation and Refund Policy

Unless specifically mentioned otherwise in the cancellation policy, Tropical Paradise does not charge a fee for cancellation of Tours (Day Visits to the resorts, Snorkelling Trips, Excursions and such short trips which can be used maximum of 8 hours). If you wish cancel any of such tours, you can cancel within 24 hours of the tour date. Prepaid payments for such tours will be refunded within 30 working days after deducting bank fees.

Cancellation due date for reservations made for accommodations (Resorts, hotels, guesthouses, liveaboards stay) is 30 working days prior to arrival date and there is no cancellation fees, if cancelled within that period. Any payments made by you, will be refunded within 30 working days after deducting bank processing fees. However, if the reservation cancelation request falls within 30 working days period, whatever the reason, there will be no refunds.

Any changes to your reservation must be made through Tropical Paradise and not directly with the accommodation provider. This applies to change of dates, extension of stay, early check out, delay of arrival or cancellation in full or in part.

We will reconfirm your cancelation by email. All refund requests must be emailed to info@tropicalparadise.com.mv, then only the process will start.

13. Additional Rules

Tropical Paradise reserves the right to post, from time to time, additional terms and conditions that apply to specific parts of the Website the Application. Such additional terms and conditions will be posted in the relevant parts of the Website or the Application, and will be clearly identified. Your use of the Website or the Application constitutes your agreement to comply with these additional terms and conditions.

14. Disclaimer of Warranty and Limitation of Liability

You acknowledge that you are using the service at your own risk. The service is provided “as is,” and to the extent permitted by applicable law, Tropical Paradise and its affiliates hereby expressly disclaim any and all warranties, express and implied, including but not limited to any warranties of accuracy, reliability, title, merchantability, non-infringement, fitness for a particular purpose or any other warranty, condition, guarantee or representation, whether oral, in writing or in electronic form, including but not limited to the accuracy or completeness of any information contained therein or provided by the service. Tropical Paradise and its affiliates do not represent or warrant that access to the service will be uninterrupted or that there will be no failures, errors or omissions or loss of transmitted information, or that no viruses will be transmitted on the service. Save for the provisions of the following clause Tropical Paradise and its affiliates shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages allegedly sustained arising out of your access to or inability to access the service, including for viruses alleged to have been obtained from the service, your use of or reliance on the service or any of the information or materials available on the service, regardless of the type of claim or the nature of the cause of action, even if advised of the possibility of such damages.

15. Privacy Policy

THE INFORMATION THAT YOU PROVIDE ABOUT YOURSELF TO MALDIVES TRAVELLER WEBSITE WILL ONLY BE USED BY TROPICAL PARADISE IN ACCORDANCE WITH ITS PRIVACY POLICY. THE PRIVACY POLICY DOES NOT APPLY TO THIRD PARTY SITES.

16. Choice of Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the Maldivian law. You also agree, subject to the following clause, to submit to the exclusive jurisdiction of the Maldives courts as regards any claim or matter arising under these terms and conditions. For the exclusive benefit of Tropical Paradise shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of your residence.

17. General

These terms and conditions are the complete and entire agreement between the parties and supersede any prior terms, conditions or agreements, whether written or oral. If any of these terms and conditions are found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. Failure of either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy. If you don’t agree to the foregoing terms and conditions, please exit the Website now or delete our Application you have downloaded.
